I was arrested for DWI, what do I do now?
Being arrested of a DWI is an offense that unfortunately happens all too often and can have major ramifications on other areas of your life. Many employers are now terminating people convicted of DWI. It is important to understand that an arrest for DWI triggers two separate cases, one is your criminal trial in which you could serve jail time and be forced to pay severe fines. The other is with the New Mexico Motor Vehicle Department in which they can revoke your drivers license or require vehicle interlocks. Because of this, there are some important things that you must do to preserve your rights in both your criminal case and your Motor Vehicle Department case. Most important in preserving your rights is meeting deadlines required by the state. In your criminal case you have a 10 day deadline to recuse your assigned judge if necessary and if you want a jury trial you may only have 10 days to request that. In addition, you must submit a written request for an administrative hearing with the New Mexico Motor Vehicle Department within 10 days of your arrest or it will result in the automatic loss of your license. Therefore, in order to help you meet all the required deadlines, you should immediately contact legal counsel and file a request for an administrative hearing with New Mexico's Motor Vehicle Department.
How much does a DWI cost?
If you are found guilty of DWI, the fines imposed by the state can be several thousand dollars and even a first offense can receive a jail sentence of up to 90 days. We will represent you for $3500 plus tax which includes representation in both your criminal trial and your MVD administrative hearing. If there are extenuating circumstances, such as an appeal or several prior DWI's, your fees may be slightly higher.
